Service Agreement

1. All information presented by MemoPros.com is for education purposes only. The material is not intended to be a substitute for medical counseling. The site is intended to help you make informed decisions about your diet and health. Before adhering to any of the information or recommendations presented throughout the BodyStandard web site and/or newsletter, please consult with your own physician or healthcare practitioner. MemoPros.com reserves the right to refuse or cancel membership for any reason, including certain medical conditions. 2. GENERAL TERMS AND CONDITIONS: You agree to: (a) maintain all equipment necessary for your access to and use of MemoPros; (b) maintain the security of your user identification, password and other confidential information relating to your MemoPros account; (c) be responsible for all charges resulting from use of your MemoPros account, including unauthorized use prior to your notifying MemoPros of such use and taking steps to prevent its further occurrence by changing your password; and (d) updating your personal information, including e-mail address. 3. MEMBERSHIP TERM: With the exception of trial memberships and special offers, the Original Membership Term ("OMT") is thirteen (13) weeks. Unless specified otherwise on this web site, after the OMT, each membership is automatically renewed every 13 weeks and members are financially responsible for all associated renewal fees until notice of cancellation is received by MemoPros.com. 4. CANCELLATION: A member may cancel. A minimum fee of one week's membership will be charged upon cancellation. Cancellations are not retroactive; therefore, if a member cancels after their membership week has begun; their membership will not be cancelled until the beginning of the next. Cancellations do not become effective until the starting date of the member's next membership week. A membership week begins on the calendar day (e.g., Monday) when a member subscribes to MemoPros.com and concludes on the day before that calendar date (e.g., Sunday) the following week. A member may cancel as follows: By email: send an email to Contact Us indicating within the body of the message your intent to cancel. Be sure to include your first and last name, user name and password. Please note that MemoPros.com will not accept or open email communications with attachments. WAIVER, RELEASE AND LIMITATION OF LIABILITY: You agree that neither MemoPros.com, nor its affiliates, subsidiaries, officers, directors, employees, agents, consultants or information providers or suppliers, shall have any liability to you under any theory of liability or indemnity in connection with your use of MemoPros.com. You hereby release and forever waive any and all claims you may have against MemoPros.com, its officers, directors, employees, agents, consultants, information providers or suppliers for losses or damages you sustain in connection with your use of MemoPros.com If you choose a diet plan of a MemoPros.com partner, you understand and agree that the diet and associated information which comprises that diet plan have been provided by the MemoPros.com partner without any assistance or help by MemoPros.com. Therefore, if you choose a diet plan of a MemoPros.com partner, BodyStandard. shall have no liability to you for any injuries, personal or otherwise, you may suffer. 6. Notwithstanding the foregoing paragraph, the total liability of MemoPros and its officers, directors, employees, agents, consultants, information providers and suppliers, if any, for losses or damages shall not exceed the fees paid by you for the particular information or service provided. All other damages, direct or indirect, special, incidental, consequential or punitive arising from any use of the information or other parts of MemoPros.com are hereby excluded even if MemoPros.com or its officers, directors, employees, agents, consultants, information providers or suppliers have been advised of the possibility of such damages. Void where prohibited by law. 7. NOTICE: MemoPros.com may deliver notice to you under this Agreement by means of electronic mail, a general notice on MemoPros.com or by written communication delivered by first class U. S. mail to your address on record in the Site's account information.
